Abstract

In the Evidence Act, documents play a crucial role. The ICT industry has undergone tremendous growth in the modern period. In modern times, electronic documents have effectively taken equal status of a paper documentation. In the future, electronic documents or records may replace paper-based documents. To stay up with the evolving global electronic industry, India, Pakistan, and Bangladesh have also progressed in this area. Three countries have acknowledged the admission of e-documents as e-evidence in their respective laws. This paper initially makes a comparative analysis of the concerned laws recognizing the electronic evidence of these countries. Secondly, it will explore whether the relevant laws of Bangladesh have any lacuna or not, comparing with the relevant laws of the other two countries. Finally, it will make a suggestion to eliminate the flaws if any.
