They have the right to choose the law of arbitration and arbitrators in case of international commercial disputes. The states generally comply with arbitral award but the state can ignore it on the excuse of public policy. This article analyses the concept of party autonomy and ordre public (public policy) and tries to find out the superiority between the two with the help of statutory provisions and judicial decisions of different countries including Bangladesh.
