Abstract

This article is a study of the debates on reform of Muslim
family law in Bangladesh. It attempts to analyse different views from different corners regarding the necessity of legal reforms. Furthermore, this paper examines the nature of the reforms that have taken place so far in Bangladeshi Muslim family law and the role of the legislature and judiciary in this regard. A study of the political viewpoint on this issue is quite pertinent and therefore that has been analysed as well. The debate over the possibility of a uniform family code or uniform civil code has also been briefly discussed. This article argues that a more inherently plural, culture-specific and identity-conscious approach of legal reform is necessary particularly for family laws in Bangladesh. Finally, this paper emphasises on how an appropriate balance could be brought about for the realisation of the rights of women in their family.
