Abstract

Constitution regulates the administration of the State. It is as the solemn expression of the will of the people and the supreme law of the Republic. Article 3 of the Constitution of Bangladesh affirms the standing of Bengali language as the State of the Republic. Moreover, Bangla Bhasha Procholon Ain (Bengali Language Implementation Act) was made in 1987 for ensuring compulsory use of Bengali in courts and offices of Bangladesh. Though the provisions for the use of Bengali language in all stages of the country are declared by the Constitution but English is still used in the Higher Courts of Bangladesh. Every people in our country speak in Bengali and most of them do not understand English properly. So, delivering of judgments in English of the Higher Courts create various problems for them especially for poor and illiterate people. Language of courts should follow the language of the Republic according to the Constitution. An attempt has been made in this article to legal analysis of the status and the enforceability of the constitutional instructions in the Higher Courts in Bangladesh.
